These Terms and Conditions govern your use of https://NostalgicCollectibles.dk and purchases made through our online store or physical shop. By accessing our platform or purchasing from us, you agree to these terms.

2. Scope and Governing Law
These Terms apply to all orders and services offered by Nostalgic. Transactions are governed by Danish law, including:
- The Danish Sale of Goods Act (Købeloven)
- The Danish Consumer Contracts Act (Forbrugeraftaleloven)
- The Danish Marketing Practices Act (Markedsføringsloven)
- The General Data Protection Regulation (GDPR)
If you are a consumer residing in another EU member state, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence.
3. Orders, Contract Formation & Payments
- Order Receipt vs. Binding Contract: When you place an order on our website, you will receive an automated email acknowledging receipt of your order (“Order Receipt”). This automated message does not constitute a legally binding acceptance of your offer. A binding contract is only formed when we dispatch your order or issue an explicit shipping/fulfillment confirmation email.
- Stock Availability & Inventory Errors: All orders are subject to availability. While we make every effort to maintain accurate real-time inventory levels, technical, human, or synchronization errors may occasionally occur. If an ordered item is out of stock, unavailable, or cannot be fulfilled due to inventory errors, we reserve the right to cancel the order prior to dispatch and immediately void any authorized payment holds.
- Pricing Errors: We reserve the right to cancel orders in the event of obvious pricing errors, system glitches, or typographical mistakes where the displayed price is clearly incorrect, in accordance with Section 32 of the Danish Contracts Act (Aftaleloven).
- Pre-Orders & Allocations: Pre-orders for upcoming product releases are subject to supplier allocations and availability. In the event that a manufacturer or distributor reduces our allocated quantity, pre-orders will be fulfilled chronologically based on order date, and any unfulfilled pre-orders will be canceled and fully refunded.
- All prices are displayed in DKK or EUR (inclusive of applicable Danish VAT), but exclude shipping fees unless explicitly stated.
- Payment Timing: For shipped online orders, payment is authorized at checkout but will not be captured/charged until your order is dispatched. For In-Store Pickup orders, payment is captured when the item is packed and marked ready for collection.
4. Shipping, Delivery & Risk
4.1 Parcel Delivery Zones
We offer direct parcel shipping to Denmark, Germany, and the Netherlands. Estimated transit times are typically 1–5 business days depending on the carrier and destination. Unless otherwise agreed, maximum delivery time is 30 days from order confirmation.
4.2 Transfer of Risk
In accordance with mandatory consumer law, the risk of loss or damage to goods remains with Nostalgic until you (or a third party designated by you, other than the carrier) take physical possession of the items.
4.3 Worldwide In-Store Pickup & Collection Deadlines
Customers located outside our direct shipping zones (as well as local customers) can select In-Store Pickup at checkout to collect items in person from our store in Billund, Denmark.
Pick-up Deadline: Once you receive an email or SMS notification that your order is packed and ready for collection, you have seven (7) days to pick it up. If the order is not collected within this 7-day period, the order will automatically be canceled. In accordance with Danish regulations on distance selling, any authorized funds will be released / the full purchase amount will be refunded directly to your original payment card.
5. Right of Withdrawal (Fortrydelsesret)
5.1 Distance Selling Returns
Under the Danish Consumer Contracts Act (Forbrugeraftaleloven), consumers buying online have a 14-day statutory right of withdrawal without giving any reason. The withdrawal period expires 14 days after the day on which you (or a designated third party) take physical possession of the goods.
To exercise your right, you must inform us via an unambiguous statement (e.g., via email or using our Standard Withdrawal Form) before the 14-day period expires. You must return the items without undue delay and no later than 14 days from the date you notified us of your cancellation.
Return Shipping & Refunds: The customer pays direct return shipping costs. We will refund all payments received from you, including standard delivery costs (excluding additional costs resulting from choosing an expensive delivery option). Refunds are issued within 14 days of receiving your cancellation notice. However, we reserve the right to withhold the refund until we have received the returned goods or proof of return dispatch, whichever occurs earlier.
5.2 Condition of Returned Goods & Sealed Collectibles
You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the items (similar to inspecting goods in a physical store).
Sealed Collectibles Notice: The commercial market value of sealed collectible items (e.g., factory-sealed booster boxes, trading card packs, sealed tins) relies strictly on their unopened state. Breaking or tampering with factory shrink-wrap or seals results in a direct loss of market value of up to 100%. In such instances, the calculated refund deduction for diminished value will equal the full purchase price.
5.3 In-Store Purchases & B2B
Statutory distance withdrawal rights do not apply to purchases made in our physical store or to Business-to-Business (B2B) transactions (purchases completed with a commercial VAT/CVR number).
6. Statutory Defect Rights (Reklamationsret)
- Under the Danish Sale of Goods Act (Købeloven), consumer purchases carry a statutory 24-month right of complaint for defects present at delivery.
- Presumption Period: Defects that become apparent within 12 months of delivery are legally presumed to have existed at the time of delivery, unless proven otherwise.
- You must report defects within a reasonable time after discovering them. Notice given within two (2) months of discovery is always considered timely.
- If a claim is justified, remedies include repair, replacement, price reduction, or a full refund, alongside reimbursement of reasonable return shipping costs.

8. Data Protection (GDPR)
Personal data collected during ordering and service handling is processed in strict compliance with our Privacy Policy and the General Data Protection Regulation (GDPR).
9. Card Grading Submission Services (CGC Submissions)
9.1 Scope of Service
Nostalgic acts as a submission agent facilitating card submissions to Certified Guaranty Company (CGC). By ordering this service, you agree to these Terms and CGC’s published terms available at https://www.cgccards.com/terms.
9.2 Service Right of Withdrawal
For standalone submission services, your 14-day distance withdrawal right applies unless performance begins with your explicit prior consent. By handing over or shipping items to us with instructions to proceed immediately, you acknowledge that withdrawal rights lapse once the grading submission service has been fully executed by dispatching items to CGC.
9.3 Handling, Care & Risk Limitations
- Professional Care: Nostalgic exercises standard professional diligence (*professionsansvar*) in handling, storing, and packaging submitted items.
- Declared Value & Insurance: Customers are required to declare accurate item market values. Nostalgic’s liability for loss or damage during local physical storage prior to third-party transit is capped at the lower of the declared value or proven market value, provided pre-submission proof of condition exists. Customers are encouraged to maintain individual private collection insurance for high-value cards.
- Subjectivity & Third Parties: Grading relies on third-party expert opinion. Nostalgic is not responsible for grading score outcomes, processing delays by CGC/couriers, or tier reclassifications assessed by CGC.
9.4 Unclaimed Collectibles
Graded items returned to us must be collected or dispatched to you within 90 days of notification. Items remaining unclaimed after 12 months will be handled or liquidated in accordance with applicable Danish law on uncollected property (*Lov om sælgeres ret til at sælge ikke-afhentede genstande*).
10. Jurisdiction
Disputes arising under these Terms shall be brought before the competent Danish courts, without prejudice to the right of non-Danish EU consumers to bring legal proceedings in their local court of jurisdiction.
